Every so often, I photograph outdoor sculptures. It's something I really enjoy because the resulting shot is a collaboration with not just the artist but the curator of the site where the sculpture is located and mother nature herself. I try not to make documents of the work, but rather stamp my own esthetic sense to the final project. But still, I'm photographing somebody else's artwork and wherever possible, I caption the images with the sculptor's name and the location of the work.

A few weeks ago, the people who represent the sculptor Tony Rosenthal favorited and invited me to post this image on the flickr group they started of his images:

Laumeier Sculpture Park by scottspaeth, on Flickr

Which I thought was cool and a pretty savvy way for them to show off his work to potential collectors. So that's all good (even if it does mean that they essentially get to use my two images of that work for free).

But then today, they felt the need to add this as a comment on the above pic:

 Quote:

House of the Minotaur, 1980

All Works of Art created by Tony Rosenthal are copyright ©Tony Rosenthal:

Even though much of Tony Rosenthal Art is located in public places, under United States Copyright Law, no Tony Rosenthal Work of Art is in the “public domain”.
If you want to reproduce, photograph, market and/or sell any Tony Rosenthal Work of Art and/or image, in any manner, and for any reason, you must obtain permission from the Tony Rosenthal Copyright Agent at http://www.VAGArights.com; e-mail: info@vagarights.com.
Getty images IS NOT the copyright agent for Tony Rosenthal.

And while all that is legally true, it's rubbing me the wrong way. Certainly they have retained the rights to all commercial use of the work, and fair enough. But the image above - and it's not a great shot, I much prefer my other take on it here - is pretty clearly NOT commercial material, and so all that crap is unnecessarily heavy handed. And annoying to a photographer who up to that point was enthusiastically on the sculptor's side. As I go to the sculpture park every so often to catch the work in different light and seasons, my feeling at the moment is to not photograph The House of the Minotaur anymore.

I'd get my picture back without his copyright shit on it and tell the guy to fuck off. What an ass.

Or just hide it for a few days. hehe

Done.

New caption reads:

House of the Minotaur by Tony Rosenthal

Out of respect to the sculptor, and due to a lack of permission granted by his copyright agent, all intellectual property not belonging to the photographer has been digitally removed from this image.
