I really think that if you are jaywalking, and you get hit, you are the one at fault and the driver of the vehicle is not at fault.
unless the driver is speeding a lot or didn't have lights on at night [for the pedestrian to see an oncoming car].
Sorta like the case where the girl got ran over by the unmarked / under cover cop car speeding through the street.
Now if we make it a case where pedestrian is liable for their own stupidity, should it also be allowed for the car owner to sue the pedestrian for causing damage to the car? (Including initiating the accident in which the first car slammed on the brakes in time to not hit the person but causing them to be rear ended by the folks behind)?
